If you are a travel advisor, agency, affiliate or content creator in our partner programme, your participation is governed by our [Affiliate Program Agreement](https://socaislands.com/about/legal-stuff/affiliate-program-agreement). **GENERAL PROVISIONS** Entire Agreement/No Waiver.These Terms of Use constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by Soca Islands of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. Correction of Errors and Inaccuracies.The Content may contain typographical errors or other errors or inaccuracies and may not be complete or current. Soca Islands therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice. Soca Islands does not, however, guarantee that any errors, inaccuracies or omissions will be corrected. Severability. If any part of these Terms of Use is found invalid or unenforceable, it will not affect any other provision of these Terms of Use, all of which remain in full force and effect. Governing Law and Disputes. These Terms of Use are governed by the laws of the State of New York, without regard to conflict-of-law rules, and by the Federal Arbitration Act. Any dispute relating to these Terms of Use, the Site, the Content or our Privacy Policy will be resolved in the same way as disputes under section 22 of our Booking Terms and Conditions: first by trying to resolve it informally for 60 days, then by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the right for either of us to bring an individual claim in small claims court and to opt out of arbitration within 30 days, as set out there. Claims may be brought only on an individual basis, not in any class or representative action. A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. **RECEIPT OF NOTIFICATION:** Upon receipt of the written Notification containing the information as outlined in 1 through 6: 1. Soca Islands will remove or disable access to the material that is alleged to be infringing; 2. Soca Islands will forward the written notification to such alleged infringer (the “Alleged Infringer”); 3. Soca Islands will take reasonable steps to promptly notify the Alleged Infringer that it has removed or disabled access to the material. **COUNTER NOTIFICATION:** An Alleged Infringer may submit a Counter Notification to contest the claim of alleged infringement. To be effective, a Counter Notification must be a written communication provided to Soca Islands‘s Copyright Agent that includes substantially the following: 1. A physical or electronic signature of the Alleged Infringer; 2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled; 3. Soca Islands will promptly provide the Complaining Party with a copy of the Counter Notification; 2. Soca Islands will inform the Complaining Party that it will replace the removed material or cease disabling access to it within ten (10) business days; 3.
