Booking Terms and Conditions
Version 2026.10.2
Effective for bookings made on or after 22 October 2026
These terms and conditions were updated on October 29 2026
These Booking Terms apply to bookings made on or after 22 October 2026. For those bookings they replace our Customer Terms of Service and our Customer Participation Agreement. Bookings made before 22 October 2026 remain under the terms in force when they were made; if you would like a copy, please contact hello@socaislands.com. Our Website Terms of Use, Privacy Policy and Customer Code of Conduct remain separate documents.
Key points at a glance
This summary is here to help you. The full terms below are what apply.
- Six-day full refund: cancel within the six days after the day you book and we refund everything you have paid, add-ons included (for bookings made at least 60 days before departure).
- Optional add-ons: add-ons you choose when you book (such as a Carnival costume, feathers, a hotel block or a group flight package) are paid to a third party on your behalf, so they are not refunded if you cancel after the six days. If we cancel your trip, they are refunded with everything else (section 6).
- After that: at 90 or more days before departure you lose your deposit and the rest becomes a 24-month travel credit; at 60 to 89 days, 50% of the trip price; under 60 days, 100%. Carnival packages have their own steps (section 6).
- Payments: deposit of US$300 per person (US$500 on Carnival trips), then monthly instalments; the balance is due 60 days before departure. We remind you before each payment, and you have 7 days' grace (section 4).
- Your price is fixed once your booking is confirmed, except for new government taxes or airline fuel surcharges, and we absorb the first 2% (section 3).
- If we cancel or make a big change, you choose between a full refund, a transfer or a travel credit (sections 8 and 9).
- Hurricanes, Carnival cancelled and similar events: you choose a 110% travel credit or a refund less costs we can't recover (section 10).
- Carnival costumes are bought directly from the band, on the band's terms (section 11).
- Travel insurance with medical and evacuation cover is required (section 14).
- Complaints: tell your host on the trip, then write to us within 30 days of returning (section 20).
1. Who we are and this contract
These Booking Terms ("Terms") form the contract between you, each traveller named on a booking ("you"), and Soca Islands LLC, a New York limited liability company, 480A Chauncey Street, Brooklyn, NY 11233, USA ("Soca Islands", "we", "us"). Contact: bookings@socaislands.com, +1 (646) 972-4274.
Your contract consists of: these Terms; the trip page or quote describing your trip at the time you booked; your booking confirmation; and the Customer Code of Conduct. If they conflict, your booking confirmation and quote take priority over the trip page, and these Terms take priority over the Code.
We organise and sell trips that combine services provided by independent suppliers such as hotels, transport companies, guides, event promoters and Carnival bands. Section 16 explains what we are and are not responsible for.
Nothing in these Terms removes or limits any right you have under the law of the place where you live that cannot be removed or limited by contract.
2. Booking with us
Holds. You may hold a place for up to 72 hours without payment. A hold is not a booking: the place is released automatically if no payment is made, and these Terms bind you only once you pay.
When your booking is confirmed. A booking is confirmed when we receive your first payment and send you a written booking confirmation. You will be asked at checkout to confirm that you have read and accept these Terms, including the cancellation charges in section 6, and to type your name as your signature. We keep a record of that acceptance.
Each traveller contracts for themselves. Each traveller pays their own share of the booking and is responsible only for their own share, unless they book as the organiser of a private group (section 13). If someone books on your behalf, your place is confirmed only once you have accepted these Terms yourself.
Accurate details. Names must match passports exactly. You are responsible for the cost of correcting details you gave us incorrectly, including airline name-change fees.
Age. Travellers must be 18 or older unless a trip page or quote states otherwise. Where a trip accepts younger travellers, a parent or guardian must book and travel with them and accept these Terms on their behalf.
Booking deadline. Bookings close 45 days before departure unless we agree otherwise in writing.
Quotes. A quote can be accepted until its "valid until" date, subject to availability. It does not reserve any space, fare or price until your deposit is received and we confirm your booking in writing.
Your account. You are responsible for keeping your Soca Islands account secure and for activity under it. Tell us immediately at bookings@socaislands.com if you think it has been used without your permission.
3. Prices
What the price includes. Prices are per person, in US dollars, based on sharing a room, and include the services listed as included on the trip page or quote at the time you booked. Anything not listed (for example flights unless stated, Carnival costumes, meals not listed, optional activities, tips and personal expenses) is not included.
Currency. Your contract price is in US dollars. Prices shown in other currencies are estimates only. Your card issuer may charge foreign transaction or conversion fees; these are not set by us.
Your price is guaranteed once confirmed. We will not increase the price of a confirmed booking except for: (a) new or increased government taxes, fees or charges; (b) airline fuel surcharges on flights we have ticketed for you; or (c) a change you ask for. We will absorb any increase of up to 2% of your trip price. We will not increase your price within 30 days of departure or after you have paid in full. If an increase is more than 8% of your trip price, you may cancel within 14 days of our notice and receive a full refund of what you have paid.
Obvious errors. If a price or trip detail shown when you booked contained an obvious error (for example a price that does not include the hotel, or a misplaced decimal point), we will tell you as soon as we discover it. You may then choose to keep the booking at the correct price or cancel it within 7 days with a full refund. We will not otherwise change your price because of our error.
Fees. We do not add mandatory fees at checkout that were not included in the advertised price, other than government charges. Any optional add-ons are shown separately, each with its own price, and section 6 explains what happens to them if you cancel.
4. Payments
Payment schedule. Your payments depend on how far ahead of departure you book:
- 90 days or more before departure: a $300 deposit per person secures your place ($500 on Carnival trips). The remaining balance is split into equal monthly payments, with the final payment due 60 days before departure.
- 60 to 89 days before departure: 50% of the trip price is due at booking, and the remaining 50% is due no later than 60 days before departure.
- Fewer than 60 days before departure: full payment is due at booking.
The exact amounts and dates for your booking are shown before you pay and in your Soca Islands account. Private and custom trips follow the schedule in the quote.
Pay in full. If you pay the full trip price at booking when a deposit option is available, you receive the pay-in-full discount shown at checkout (currently 5%), subject to section 5.
Payment methods. We accept the card and payment methods shown at checkout, processed by our payment provider. If you choose automatic instalments, you authorise us to charge your card on each due date shown in your account.
Missed payments. We will remind you 7 days and 1 day before each payment is due. If a payment is not received by its due date, you will have a 7-day grace period to pay it. If it is still unpaid after the grace period, we may cancel your booking and the cancellation charges in section 6 will apply as if you had cancelled on that date. A late fee of US$25 applies to payments made during the grace period.
Services are released to you only once your trip is paid in full.
5. Discounts, promotions and credits
Only one discount or promotion applies to a booking unless the offer says otherwise. Promotions apply to the trip price only, not to supplements, flights or add-ons.
Early booking discount. Where offered, the early booking discount (currently 10%) applies to the first three places sold on each departure. It does not apply to waitlist bookings.
Returning traveller discount. Travellers who book a new trip within 12 months of the end of their last Soca Islands trip receive the returning traveller discount shown at checkout (currently 5%).
Private events and negotiated group prices do not receive the pay-in-full or returning traveller discounts. Only a promo code issued by us for that event may lower the agreed price.
If you cancel or transfer, any discount is recalculated on what remains of your booking, and a discount linked to a condition you no longer meet (for example paying in full) is withdrawn.
Travel credits issued by us are not cash, cannot be exchanged for cash, are personal to the named traveller unless we agree otherwise, and are valid for 24 months from issue unless the credit states a longer period or the law where you live requires otherwise. Gift cards are governed by separate Gift Card Terms.
6. If you cancel
How to cancel. Cancellations must be sent in writing to bookings@socaislands.com. Your cancellation takes effect on the day we receive it. Disputing a payment with your card issuer is not a notice of cancellation.
Six-day full refund. If you cancel within the six days after the day you make your booking, we will refund all payments you have made, including for add-ons. For example, if you book on 13 October, you can cancel until the end of 19 October. The exact date is shown when you book and in your Soca Islands account. This applies to bookings made at least 60 days before departure.
Optional add-ons. Some trips offer add-ons that you choose when you book and that are priced separately from the trip, such as a Carnival costume, feathers, a hotel block or a group flight package. We pay for an add-on to a third party on your behalf, such as a mas band, a hotel or an airline, and we cannot get that money back. So if you cancel after the six-day full refund period, add-ons are not refunded, and any part of an add-on's price you have not yet paid is still due. The cancellation charges below apply to your trip price only, never to add-ons. If you transfer your place to another person, your add-ons go with it, subject to any name-change charge the supplier makes. If we cancel your trip (section 9), if we make a significant change and you cancel (section 8), or if your roommate cancels and you choose to cancel (section 7), add-ons are refunded with the rest of what you have paid. If an event beyond our control stops your trip, section 10 applies.
After six days. From the seventh day after the day you book, the following charges apply to your trip price when you cancel (add-ons are covered above):
- 90 or more days before departure (Carnival packages: 120 or more days): you lose your deposit; any payments above it become a travel credit valid for 24 months.
- 60 to 89 days before departure (Carnival packages: 60 to 119 days): 50% of your trip price (Carnival packages: 75%).
- Fewer than 60 days before departure, or if you do not show up: 100% of your trip price.
If the charge is more than you have paid, you must pay the difference; if you have paid more than the charge, the excess is refunded under section 6.
Why these charges apply. We commit to hotels, event tickets, transport and guides on your behalf, often months before departure and often on non-refundable terms, and we hold your place in a small group. These charges reflect those commitments and the loss of a place we usually cannot resell close to departure.
Refunds we owe are paid to the original payment method within 14 days of your cancellation, less any amounts covered by section 6. Card processing fees already paid are not deducted.
Transfers to another person. You may transfer your place to another person, up to 14 days before departure, if they accept these Terms, meet any entry and age requirements, and pay any supplier name-change charges. The payments already made move with the place; we do not refund them to you.
Changing departure date or trip. A change to a different departure or trip is treated as a cancellation and new booking, unless we agree otherwise in writing. We may allow one change free of charge more than 90 days before departure, subject to availability.
Unused services. If you leave a trip early, miss part of it or choose not to use a service, we cannot refund the unused part. Your travel insurance may cover this.
7. Rooms and roommates
Prices are based on sharing a room with another traveller. Single rooms are available on request, at the single supplement shown, and subject to availability.
If you book to share and have no roommate, we will pair you with a traveller of the same sex. You may later switch from a single to a shared room if a roommate is available.
If your roommate cancels, we will try to pair you with another traveller of the same sex. If we can't, you may choose to: (a) pay the single supplement, if a single room is available; (b) transfer to another departure at no charge; or (c) cancel and receive a full refund of what you have paid. We will not increase your price without your agreement.
8. Changes to your trip by us
We plan trips months in advance and sometimes need to make changes. Most are minor, such as a change of guide, the order of activities, a flight or transfer time of less than 12 hours, or a hotel of the same or higher standard. We will tell you about minor changes as soon as reasonably possible and no compensation is due.
Significant changes are: (a) a change of destination or of departure or return date; (b) a change to accommodation to a lower standard for more than one night; (c) removal of included activities or events affecting more than 1 in 4 days of the trip; (d) a change of departure or return time of more than 12 hours; or (e) for Carnival packages, the matters described in section 11.
If we have to make a significant change before departure, we will tell you promptly and you may choose to: (a) accept the change, with a refund of any price difference if the changed trip costs less; (b) take an alternative trip of equal or higher value, if available; or (c) cancel and receive a full refund of what you have paid. Please tell us your choice within 7 days of our notice; if you do not reply, you will be treated as accepting the change.
Supplier substitution. If a supplier cannot provide a service (for example a hotel overbooks or a transport company withdraws), we may substitute a comparable or better service. If the substitute is of lower value, we will refund the difference.
Changes during the trip. Our hosts may change the itinerary during the trip for safety, weather, local conditions or the welfare of the group. Where a change during the trip means an included service is not provided and we save its cost, we will refund what we save.
Section 8 does not apply to changes caused by you, or to events covered by section 10 except as stated there.
9. If we cancel your trip
Minimum numbers. Scheduled trips need at least 6 travellers to operate unless the trip page says otherwise. If a departure has not reached its minimum, we may cancel it by notice given no later than 45 days before departure.
Other reasons. We may also cancel a trip before departure for operational reasons, or under section 10 or section 11.
Your choices. If we cancel for a reason other than an event covered by section 10, you may choose: (a) a full refund of what you have paid, within 14 days; (b) a transfer at no charge to another departure of the same trip; (c) a transfer to a different trip, paying or receiving any difference in price; or (d) a travel credit worth 105% of what you have paid, valid for 24 months.
We are not responsible for costs you incur separately from your booking, such as flights, visas or vaccinations you bought yourself, except where we cancel within 45 days of departure for reasons within our control, when we will reimburse reasonable, documented non-refundable flight costs up to US$500 per traveller. We recommend that you do not buy non-refundable flights until we confirm your departure is guaranteed.
10. Events beyond our control
Meaning. An event beyond our control is one that neither we nor our suppliers could have avoided by taking all reasonable care, such as hurricanes and severe weather, earthquakes, floods, volcanic activity, epidemics and pandemics, war, terrorism or the threat of them, civil unrest, government action (including travel advisories against all travel, border closures and quarantine orders), cancellation or postponement of Carnival or a major event by an authority, airport or port closures, strikes, fire, and failure of public utilities.
Before departure. If such an event means your trip cannot operate as booked, we will offer you the choice of: (a) a travel credit worth 110% of what you have paid, valid for 24 months; or (b) a refund of what you have paid, minus non-recoverable costs we have already paid to suppliers for your booking, which we will itemise in writing. If the trip can operate with significant changes, section 8 applies.
If you choose not to travel when the trip is operating and no government authority advises against travel to the destination, your cancellation is treated under section 6.
During the trip. If such an event happens during your trip, we will help you, including with alternative arrangements and contact with your insurer. We are not liable for extra costs such as additional nights or new flights; your travel insurance should cover these. Where the event means included services are not provided and we recover their cost, we will refund what we recover.
11. Carnival packages
What's included. Carnival packages include the hotel, fete or event tickets, transfers and other services listed on the trip page. Carnival costumes are not included in the trip price, but on some trips you can add a costume and feathers as an optional add-on.
Costumes. You can buy your costume, and feathers, as an optional add-on when you book with us, or directly from the Carnival band. Either way, the band makes and supplies the costume under its own rules on sizing, section placement and collection or distribution. When you buy through us, we pay the band on your behalf: section 6 explains what happens if you cancel, and if the band fails to supply a costume you bought through us, we will refund what we recover from the band. When you buy directly from the band, that is a separate contract between you and the band, under its own prices, deposits and refund rules; we are not a party to it and are not responsible for the band's performance, delays or refunds. If we help you choose a band or register, we do so as a courtesy.
Bands, promoters and events are independent. Carnival bands, fete promoters and event organisers are independent businesses and are not owned by or affiliated with Soca Islands unless we say so in writing. They decide line-ups, performers, venues, start times, routes, section placements, capacity and the rules of their events.
Changes to Carnival events. A change of performers, venue, start time or format of an included fete is a minor change. If an included fete or event is cancelled, we will substitute a comparable event where we can; if we cannot, we will refund what we recover from the promoter for your ticket. It is a significant change under section 8 if two or more included fetes are cancelled without a comparable substitute.
If Carnival is cancelled or postponed. If an authority cancels Carnival or moves it to different dates, section 10 applies. If it is postponed, we will first offer to move your booking to the new dates where our suppliers allow it.
Safety during Carnival. Carnival involves very large crowds, heat, loud music, alcohol, late nights, uneven surfaces and long periods of walking and dancing. You take part in the road and fetes knowing these risks. Please follow your host's safety briefing, stay with your group, keep valuables to a minimum, drink water and know your meeting points.
Hotel stays. Carnival hotel rates usually require a minimum stay and full prepayment. There is no refund for nights you do not use.
12. Flights and multi-country trips
Flights we book. Where your quote includes flights, the airline is the carrier and its conditions of carriage apply. Many fares are non-refundable and cannot be changed once ticketed; the fare rules for your flights are shown in your quote. The airline's liability for death, injury, delay and baggage is governed by the Montreal Convention or other applicable international conventions, and our liability for air travel is limited in the same way.
Airline changes and refunds. Airlines may change schedules. We will tell you of changes we are notified of and help you rebook. If an airline cancels or significantly changes a flight we sold you and you are entitled to a refund under applicable law, we will pass that refund on to you promptly.
Flights you book yourself. If you book your own flights, you are responsible for arriving and departing at the times stated in your joining instructions. We are not responsible for missed services, transfers or connections caused by your flights, or for flight costs if you miss the start of the trip.
Multi-country trips. You must meet the entry requirements of every country on the itinerary, including countries you transit. Some countries refuse entry to travellers with certain previous travel or nationalities; please check before booking.
13. Private groups and custom trips
A private group or custom trip is booked on the conditions in its quote together with these Terms. If they conflict, the quote applies.
Group organiser. The person who accepts the quote for a private group (the "organiser") confirms they are authorised to book for the group, must give us the names and details of all travellers by the deadline in the quote, and is responsible for the group deposit and any shortfall under the group size rules below unless the quote says each traveller pays separately.
Group size. Group prices are based on the number of travellers in the quote. If the final number falls below that number, we may adjust the price per person according to the price table in the quote, or the organiser may pay the difference.
Deposits and payments for private and custom trips follow section 4: a deposit of US$300 per traveller in the group (US$500 per traveller on Carnival trips), with the balance on the schedule in section 4, unless the quote states otherwise.
Each traveller in a private group must accept these Terms before travel.
14. Your responsibilities before you travel
Passports, visas and entry rules. You are responsible for having a valid passport (most countries require at least six months' validity beyond your return date and blank pages), any visas, electronic travel authorisations, health certificates and vaccinations needed for your trip, and for meeting the entry and exit rules of every country you visit or transit. We can give general information only; please check with the relevant embassy or consulate and your doctor. If you are refused boarding or entry because you do not meet these requirements, section 6 applies and you must reimburse any fines or costs imposed on us.
Health and fitness. Our trips involve walking, heat and long days, and Carnival packages involve strenuous activity. Please tell us before you book about any medical condition, disability or dietary need that may affect your trip, and update us if anything changes. We will consider each request individually and make reasonable adjustments where we can. If, after discussing it with you, we reasonably conclude that we cannot safely accommodate a need, we will tell you before confirming your booking or, if we learn of it later, offer you a transfer or cancellation without charge where you told us before booking, or under section 6 where you did not. We may ask for a doctor's confirmation that you are fit to travel.
Travel insurance. You must have travel insurance covering at least emergency medical expenses of US$100,000 and emergency evacuation and repatriation of US$250,000 for the whole trip, including the activities in your itinerary. We strongly recommend cancellation and trip interruption cover, and cancel-for-any-reason cover where available, because our cancellation charges apply in most circumstances. Please give us your insurer's name, policy number and emergency number at least 30 days before departure. You may choose any insurer; we do not sell insurance.
Staying in contact. Please carry a working mobile phone with a roaming or local data plan and WhatsApp installed throughout the trip. Trip schedules and updates are sent by WhatsApp and email.
15. Conduct during the trip
You agree to follow the Customer Code of Conduct, the reasonable instructions of our hosts and suppliers, and the laws and customs of the countries you visit.
We do not tolerate harassment, discrimination, violence, threats, illegal drug use or behaviour that endangers, disturbs or offends other travellers, our staff or suppliers. You must not take part in any activity while impaired by alcohol or drugs to a degree that puts you or others at risk, and our hosts may exclude you from an activity for that reason.
If your behaviour breaks these conduct rules, our host may, after a warning where it is safe to give one, exclude you from activities or remove you from the trip. If you are removed, we will not refund any part of your trip, and you must pay your own costs of accommodation and travel home. We may refuse future bookings from you.
You must pay for any damage or loss you cause to property, and any fines or charges imposed on us or our suppliers because of your actions.
Transport timings. Transfers leave at the scheduled time. If you are more than 15 minutes late a late fee of US$30 applies; after 30 minutes the transfer may leave without you and you must make and pay for your own way to the next stop.
16. Our responsibility to you
Our commitment. We will plan your trip with reasonable skill and care and select our suppliers with reasonable care, including checking that transport and activity providers hold the licences and insurance locally required.
Independent suppliers. Hotels, airlines, transport companies, guides, activity providers, event promoters and Carnival bands are independent businesses, not our employees or agents. They provide their services under their own terms and the laws of the country where they operate, which may differ from the standards in your home country. We are not responsible for their acts or omissions unless we failed to take reasonable care in selecting them or the law of your place of residence makes us responsible.
Limits on our liability. To the extent permitted by law: (a) our total liability for any claim that does not involve death, personal injury or illness is limited to the price you paid for your trip; (b) we are not liable for indirect or consequential losses, lost earnings, or losses you could have avoided; (c) where a claim relates to a service governed by an international convention (for example air travel under the Montreal Convention or sea travel under the Athens Convention), our liability is limited in the same way as the carrier's; and (d) we are not responsible for loss of or damage to personal belongings, cash or valuables, which your insurance should cover.
What we do not exclude. Nothing in these Terms limits our liability for death or personal injury caused by our own negligence, for our gross negligence, wilful misconduct or fraud, or for any liability that cannot be limited under applicable law.
Optional activities and free time. Activities you book directly with local providers during free time, or that are not listed in your itinerary, are contracts between you and that provider. Our hosts may recommend providers as a courtesy only.
Medical care. If you need medical help during the trip our hosts will help you get it, but medical facilities and standards vary and we are not responsible for the care provided.
17. Risk acknowledgment
Travel, particularly to festivals and in countries with different infrastructure, carries risks that careful planning cannot remove, including road and traffic conditions, crowds, heat, water activities, wildlife, crime, illness and natural events. By booking you confirm that you understand these risks and choose to accept them.
Taking part in any activity is your choice. You may decide not to take part in an activity at any time, and our hosts may decline to let you take part where they reasonably believe it is unsafe for you or others.
Some activities (for example boat trips, water sports, hiking or zip-lining) may require you to sign the provider's own waiver on the day. If you decline, you may not be able to take part, and no refund is due for that activity.
18. Photos and media
Our hosts and photographers may take photos and video during trips, and we may use them, and photos you share with us or tag us in, to promote Soca Islands on our website, social media and marketing materials.
You can opt out at any time, at booking or later, by emailing hello@socaislands.com. We will tell our hosts not to feature you, and we will remove images of you from our own channels and stop using them in new materials within 30 days. We cannot recall printed materials or posts already shared by others.
Please respect other travellers: ask before photographing or posting someone, and remove content if they ask you to.
19. Your personal information
We use your personal information to provide your trip, including sharing the details our suppliers need (for example names, passport details, dietary and accessibility needs) with hotels, transport companies, event promoters and authorities in the countries you visit, some of which may have different data protection laws. Our Privacy Policy explains how we collect, use, keep and protect your information and your rights. By booking, you confirm that you have read it.
If you give us information about another traveller, you confirm that they have agreed to you doing so.
20. Complaints
If something is wrong during your trip, please tell your host straight away so we can try to fix it. Problems we are not told about at the time are much harder to put right, and this may affect any compensation.
If your concern is not resolved, please write to bookings@socaislands.com within 30 days of the end of your trip with your booking reference and details. We will acknowledge your complaint within 5 business days and aim to respond in full within 30 days.
To the extent permitted by law, any claim against us must be started within one year of the end of your trip (or of the scheduled end date, if the trip did not take place).
21. Card payments and disputes
If you believe a charge is incorrect, please contact bookings@socaislands.com before contacting your card issuer, so we can review it with you. Nothing in these Terms limits your rights under applicable law or your card issuer's rules.
A card dispute is not a cancellation. Your booking remains in place, and the cancellation and payment terms in sections 4 and 6 continue to apply, unless you cancel in writing under section 6.
If you dispute a charge made in line with these Terms, we will provide your card issuer with your recorded acceptance of these Terms, your booking details, communications and payment history. If the dispute is decided in our favour, the disputed amount remains payable.
22. Disputes and governing law
Let's talk first. Before starting any formal claim, you and we agree to try to resolve the dispute informally for 60 days, starting when one of us sends the other a written description of the dispute (to bookings@socaislands.com for us, and to the email address on your booking for you).
Arbitration. If the dispute is not resolved, it will be decided by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in force, available at adr.org. Fees are payable as set out in those rules, which limit the consumer's share. The arbitration will take place by video or written submissions unless the arbitrator decides an in-person hearing is needed, in which case it will be held in the county where you live or in New York County, New York, at your choice. The arbitrator may award any individual relief a court could award.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may ask a court to stop the misuse of intellectual property.
Individual claims only. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, consolidated or representative action. If this paragraph is found unenforceable for a particular claim, that claim will proceed in court and not in arbitration. If 25 or more similar claims are filed by or with the same counsel, they will be administered in batches under the AAA's mass arbitration procedures.
Opting out. You may opt out of arbitration by emailing bookings@socaislands.com within 30 days of first accepting these Terms, with your name, booking reference and a statement that you opt out. Opting out does not affect any other part of these Terms.
Governing law and courts. These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, and by the Federal Arbitration Act. Any dispute not subject to arbitration will be decided by the state or federal courts located in New York, and you and we both waive any right to a jury trial to the extent permitted by law.
Customers outside the United States. If you live outside the United States, these Terms do not deprive you of the protection of mandatory consumer laws of your country of residence, and you may bring proceedings in your local courts where those laws give you that right.
23. Notices and communications
We will send notices about your booking to the email address and WhatsApp number on your booking. Please keep them up to date. You agree to receive your booking documents, these Terms and notices electronically.
Send notices to us at bookings@socaislands.com or Soca Islands LLC, 480A Chauncey Street, Brooklyn, NY 11233, USA.
24. General
Changes to these Terms. We may update these Terms from time to time. The version you accepted when you booked applies to your booking. A later version applies only if you accept it, for example when you change your booking, or if the change only benefits you. Previous versions are available on request.
Severability. If any part of these Terms is found invalid or unenforceable, it will be limited to the minimum extent necessary and the rest will remain in force.
Transfer of our rights. We may transfer our rights and obligations under these Terms to another organisation that will operate your trip on the same terms, and will tell you if we do. You may not transfer your rights except as set out in section 6.
No waiver. If we do not enforce a right immediately, we may still enforce it later.
Language. These Terms are written in English. Translations are for convenience; the English version prevails if they differ.
Entire agreement. The documents listed in section 1 are the entire agreement between you and us about your booking and replace any earlier statements, except statements in writing from us about your specific booking.
